In consideration of participating in the SPORT OF PAINTBALL I represent, that I understand the nature of this activity and that I am qualified, in good health, and in proper physical condition to participate in such activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participating in the activity. I am able to read and understand English and I am being completely truthful in my age when filling out this form. I understand agree that all of the activities in this Park, by their nature, inherently dangerous and that I could be seriously injured or die if I participate in any such activities. I agree to abide by ALL of All Out Paintballs safety rules and conditions of participation and agree to ask any questions about such rules if I have any questions or concerns.

I fully understand that this activity involves risks of serious bodily injury, including permanent disability, paralysis, and death, which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the “releases” named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for the losses, costs, and damages I incur as a result of my participation in the activity. I understand that I am fully liable and financially responsible for the Medical Assistance needed as a result of participating in Paintball activities and for equipment issued or rented to me. I also understand that I am financially responsible to All Out Paintball for the (loss/damage) of any such issued/rented equipment and may be prosecuted. I also understand that only paintballs purchased from All Out Paintball are allowed for use in the park.

I hereby release, discharge, and covenant not to sue All Out Paintball, its respective members, governors, administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the activity takes place, or lessors of any equipment used in the activity, (each considered one of the “RELEASES” herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence or gross negligence or the “releases” or otherwise, including negligent rescue operations; and I further agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the releases, I will indemnify, defend, and hold harmless, each of the Releases from any loss, liability, damage, or cost which any may incur as the result of such claim.

I have read this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, understand that I have given up substantial rights by signing it freely and without any inducement and assurance of any nature and intend it be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect. AND if signing for a minor, I, the minor’s parent and/or legal guardian, understand the nature of the above referenced activities and the minor’s experience and capabilities and believe the minor to be qualified to participate in such activity. I hereby release, discharge, covenant not to sue and AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS each of the Releases from all liability, claims, demands, losses, or damages on the minor’s account caused or alleged to have been caused in whole or in part by the negligence or gross negligence of the Releases or otherwise, including negligent rescue operations, and further agree that if, despite this release, I, the minor, or anyone on the minor’s behalf makes a claim against any of the above Releases, I WILL INDEMNIFY, DEFEND AND HOLD HARMLESS each of the Releases from any litigation expenses, attorney fees, loss liability, damage, or cost any Releasee may incure as the result of any such claim. The undersigned assumes all liability for misrepresentation of guardianship

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE of those persons released from liability below, and assume full responsibility for my participation

I understand that the activities of paintball are physically and mentally intense. I understand the rules of play and will comply with all rules and regulations. If I observe an unusual or unnecessary hazard during my participation, I will bring such to the attention of the nearest official as soon as practical

I, for myself and on the behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS FROM LIABILITY ALL OUT PAINTBALL, the owners and lessors of premises used to conduct the paintball activities, their officers, officials, agents and/or employees (’Releases“), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASES OR OTHERWISE

I understand and agree that this Release of Liability Agreement covers each and every paintball activity and event in which I participate hereafter. I acknowledge and agree that by checking this box and typing my full legal name below, I am electronically signing this document. I understand that my electronic signature has the same legal force and effect as a handwritten signature and that I am legally bound by the terms and conditions contained in this agreement.
